AUCTION DETAILS
Pursuant to an Order, dated August 10, 2018, by the Circuit Court for Baltimore City in case entitled
- Brooks, Inc., v. 9 Jewels, LLC, et al., Case No. 24-C-17-001809, the undersigned court appointed trustee,
will sell at public auction the fee simple lot of ground and the improvements thereon, situate and lying in
Baltimore City, Maryland, and known as 306 North Howard Street, Baltimore, Maryland 21201 a/k/a 306-310
North Howard Street, Baltimore, Maryland 21201. See Deed, dated March 19, 2015, and recorded among the
Land Records of Baltimore City, Maryland, at Liber 17022, Page 121. See also Baltimore City Account
Identifier: 04/02/0577/004.
Deposit Amount: An Initial Deposit of $10,000.00 in cash or cashier’s check to be made at the time of sale by the
Winning Bidder (hereinafter referred to as “Purchaser”), with an Additional Deposit by cashier’s check or wire
transfer to bring the total deposit up to 10% of the Purchase Price to be made within two (2) business days of the
conclusion of the Auction at the offices of the Auctioneer, all in accordance with the Bidder Terms.
Required Contract Signing and Affidavit from Purchaser: The Purchaser, immediately after the auction, will be
required to execute a Contract of Sale according to the terms in this Notice and as announced by the auctioneer.
Further, the Purchaser will be required to execute an “Affidavit of Purchaser” which will be filed with the Circuit
Court for Baltimore City in the referenced court proceeding. In said Affidavit, the Purchaser shall state, under the
penalties of perjury that the Purchaser is not acting as an agent for other parties, there are no other principals
involved, and the Purchaser has not directly or indirectly discouraged anyone from bidding on the property.
Interest on Purchase Price: The Purchaser shall pay to the Trustee interest at the rate of 10% per annum on the
unpaid balance of the Purchase Price from the date of the Auction until the date of Closing, due and payable at
Closing.
Assignability of Contract of Sale: The Contract of Sale is not assignable by the Purchaser without the express
written permission of the undersigned Trustee, said decision being within his sole and absolute discretion.
Closing: The sale is subject to final ratification by the Circuit Court for Baltimore City and subject to the
undersigned Trustee’s ability to convey clear and marketable title, free and clear of all liens and encumbrances.
Closing shall be within thirty (30) days from the entry of the Order by the Circuit Court for Baltimore City ratifying
the sale. TIME IS OF THE ESSENCE. If the undersigned Trustee is unable to obtain said Order, if he is unable to
convey said clear and marketable title, of if there is any other impediment to completing the sale, the sale shall be
null and void and the Purchaser’s sole and only remedy will be a refund of the deposit remitted, all other remedies in
law or equity being waived by the Purchaser. If the Purchaser breaches the Contract of Sale, the Trustee shall be
entitled to all remedies, in law or equity, as may be awarded by the court.
Closing Costs, Transfer and Recordation Tax: All settlement costs, except “Adjustments” noted below are the
responsibility of the Purchaser. All transfer and recordation taxes are to be paid by Purchaser.
Adjustments: The following items pertaining to the Property are to be prorated or adjusted as of the date of
Closing: any ground rent, special assessment liens, sewer and water charges, and operating or utility charges actually
collected, billed, or paid as of the date of Closing; real property taxes; utilities; rental, additional rental and any other
charges under all leases.
Condition of the Property: THE PROPERTY IS SOLD “AS-IS, WHERE-IS”, WITHOUT ANY WARRANTY
OR REPRESENTATION AND SUBJECT TO ANY EASEMENTS, RESTRICTIONS, COVENANTS OR
AGREEMENTS OF PUBLIC RECORD. ANY INFORMATION PROVIDED BY AUCTIONEER ON ITS
WEBSITE OR OTHERWISE IS WITHOUT WARRANTY OR REPRESENTATION AND SHOULD BE
INDEPENDENTLY VERIFIED BY THE BIDDERS.
Access to the Property: AS THE SALE OF THE PROPERTY HAS TO BE RATIFIED BY THE CIRCUIT
COURT FOR BALTIMORE CITY, POSSESSION OF THE PREMISES CANNOT BE TAKEN BY THE
PURCHASER UNTIL CLOSING. FURTHER, AS THE TRUSTEE DOES NOT HAVE ACCESS TO THE

PROPERTY, ACCESS TO THE PROPERTY CANNOT BE GIVEN TO THE PURCHASER PRIOR TO
CLOSING.
Broker Co-Op: A 0.5% Commission on the Winning Bid Amount (excluding the Buyer’s Premium) will be paid to
a properly registered and licensed broker or agent of the Purchaser. Said commission shall be paid at the Closing of
the Property and shall only be paid if Closing actually occurs. All brokers must complete and submit the Broker
Registration Form at least 24 hours prior to each Auction to be eligible to receive the commission for that property.
The Broker Registration Form is available on the Auctioneer’s website. No commission will be paid to any broker
who is a partner, stockholder or principal of the entity purchasing the property.
Agency Disclosure: The Auctioneer is acting as auctioneer/agent for the Seller only.
Bidder Terms: By bidding on the Property, you acknowledge that you are subject to the Terms of Use, Privacy
Policy, Bidder Terms, and all other documents that pertain to the transaction available on Auctioneer’s website. By
placing a bid, you acknowledge that you have reviewed the Bidder Terms and understand they are subject to change
as may be announced prior to the time of sale. Pursuant to the Bidder Terms, if you are the Purchaser, you will be
required to enter into the Contract of Sale on Auctioneer’s standard form, which must be reviewed on Auctioneer’s
website prior to the auction.
